App License (EULA)

This End User License Agreement (“EULA”) is between you and Vitali Haus (“we”, “us”). It covers the Vitali Haus app (the “App”) on iPhone, iPad and Android devices.

You acknowledge that this EULA is concluded between you and Vitali Haus only, and not with Apple Inc. (“Apple”) or Google LLC (“Google”). Vitali Haus, not Apple or Google, is solely responsible for the App and its content. Nothing in this EULA allows use of the App that conflicts with the Apple Media Services Terms and Conditions or the Google Play Terms of Service in force when you accept it.

The App is part of the Vitali Haus service, so our Terms of Service, Privacy Policy and Community Guidelines also apply to everything you do in it.

We grant you a personal, nontransferable, nonexclusive, revocable license to use the App on any Apple branded device that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions (the App may also be used by other accounts associated with you through Family Sharing or volume purchasing), or on Android devices you own or control under the Google Play Terms of Service.

You may not:

• copy, modify, rent, lease, lend, sell, redistribute or sublicense the App;
• reverse engineer, decompile or try to extract its source code, except where the law allows it despite this restriction;
• remove any notice of ownership, or use the App to break the law or our Terms of Service.

The App is licensed, not sold. We keep all rights not expressly granted to you.

The App lets people post profiles, photos, videos and messages. There is no tolerance for objectionable content or abusive users. By using the App you agree not to post or send anything that our Community Guidelines forbid, including harassment, threats, hate, sexual content, content that sexualizes minors, and dangerous health content.

• You can report any profile, message, campaign or piece of content in the App, and block any user.
• We review every report within 24 hours, remove content that breaks the rules, and suspend or ban the user who posted it.

Vitali Haus is solely responsible for providing any maintenance and support for the App, as described on our Support page or as required by law. You acknowledge that Apple and Google have no obligation at all to provide maintenance or support services for the App.

Vitali Haus is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. The App is provided “as is” to the fullest extent the law allows.

If the App fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. The App is free to download, so that amount is normally zero. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the sole responsibility of Vitali Haus.

Vitali Haus, not Apple or Google, is responsible for addressing any claims from you or any third party relating to the App or your possession and use of it, including:

• product liability claims;
• any claim that the App fails to conform to any applicable legal or regulatory requirement; and
• claims arising under consumer protection, privacy or similar legislation.

If any third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, Vitali Haus, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.

You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a “terrorist supporting” country; and (ii) you are not listed on any United States Government list of prohibited or restricted parties.

You must comply with any third party terms that apply when you use the App, for example your mobile carrier’s data terms, and the terms of the services you connect, such as Apple, Google, Stripe, Instagram, TikTok or YouTube.

We may release updates that add, change or remove features; this EULA covers them. This license lasts until you or we end it. You can end it by deleting the App and your account (see Delete your account). It ends automatically if you break this EULA, and we may end it if we close your account under the Terms of Service. When it ends you must stop using the App.

The App shows content made by creators and brands about health, wellness and longevity. It is not medical advice, and Vitali Haus is not a healthcare provider. Talk to a qualified professional before changing any medicine, diet or exercise routine.

This EULA is governed by the laws of the State of Florida, United States, and disputes are resolved as set out in the Terms of Service, except where your local law gives you rights that cannot be changed by agreement.

You and Vitali Haus acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
